On November 30th, 2020, we received another I-140 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Environmental Science (Approval Notice).

Case Summary:

North America Immigration Law Group (NAILG) was approached by a postdoctoral researcher from Taiwan to assist him in filing an I-140 NIW petition. Based on his meticulous qualification, he seemed to be a deserving candidate to secure an NIW approval. Once we had confirmed his credentials and both the parties consented to the terms of the contract, we went about establishing a strong case for him.

According to the matter of Dhanasar (The analytical framework for assessing eligibility for National Interest Waiver), the USCIS needed the following information in our client’s petition packet:

  • The foreign national is a member of the professions holding an advanced degree;
  • The foreign national proposed endeavor has both substantial merit and national importance;
  • The foreign national is well-positioned to advance the proposed endeavor; and
  • On balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.

To assure the USCIS that our client is well deserving to continue his research work, we stated all the 164 citations collected from the 13 peer-reviewed journal articles (6 of them first-authored) he published. Furthermore, these papers have been published in the top journals in our client’s field, which indicates his peers’ recognition of the value of these research works. We also noted the 13 times our client judged the work of his peers. We also demonstrated his research on the feedback mechanisms behind hydrological and biogeochemical processes has great importance as it responds to the major environmental concerns regarding air quality, ecosystem management, and forest mortality. Substantially, his research has generated many solutions to several global concerns resulting from environmental damage.

It was indispensable for us to incorporate the letters of recommendation into the petition package, and based on our suggestion, our client obtained four such recommendation letters from the other renowned experts in the same field providing further insight into the merit of this endeavor. The words contributed by an Assistant Professor read:

“[Our client] is an environmental scientist who has bridged the gap between modeled and measured particle depositions for atmospheric aerosol particles… As a significant contributor to research on the reduction of atmospheric aerosol particles in the environment, He is a leading researcher in environmental science.”

Everything considered, all the four recommendation letters evidently expressed our client’s potential and caliber to continue his research work in the United States.
