Case Summary:

North America Immigration Law Group was approached by a Ph.D. candidate to help him build an EB-2 NIW (National Interest Waiver) petition. Our client was well aware that we would require proper documentation of his past achievements and a strong background to file the petition, and he provided us with the same as soon as possible. After examining his solid credentials, we countersigned the retainer agreement. Our priority was to confirm to the USCIS that our client is qualified for the national interest waiver approval.

Therefore, we added the following details in his petition packet:

Research Overview: We noted that our client, an expert in the field of biochemistry, intends to advance cancer diagnostics and treatment worldwide, which has great substantial merit and national importance. Thus, it is crucial that his research progress is made in terms of finding more efficient ways to treat the diseases here in the United States.

Publication, Citation, and Funding Activity: We cited our client’s excellent publication and citation record. At the time of filing for the petition, his publication included seven peer-reviewed journal articles (one of them first-authored). He has published papers in no fewer than three highly ranked peer-reviewed journals, which have been cited a total of 174 times. Moreover, in recognition of the value and importance of his investigations, it has also been granted funding by the National High-Tech Research and Development Program of China, and the National Natural Science Foundation of China. These prominent institutions are committed to supporting innovative research on major scientific issues in agriculture, energy, information resources and environment, population and health, materials, and other related areas, and funding is incredibly competitive.

Letters of Recommendation: We also comprised four recommendation letters in his petition packet, presenting other expert’s acknowledgment of our client’s education and training, his documented record of scholarly publication, the recognized influence of his research in the field, his clear future research plans, and employment letter confirming his current position and indicating his advisor’s intent to hire him following the completion of his Ph.D. One of his fellow experts in the field provided the following insight into the merit of his project:

“As suggested by the citations of his work, his research is of great interest to the field. A variety of means of diagnosing cancer and delivering drugs to tumor sites have been emerging in the biochemistry field recently, including nanoparticles and quantum dots… [Client’s] research pinpoints the effects of these substances at the mitochondrial level, investigating the effects of nanoparticles and quantum dots on the mitochondrial functioning of cells. With his focus on materials that induce mitochondrial swelling and collapse of membrane potential, his research is bringing forward important new knowledge about how diagnostic measures and therapeutic treatments have unintended effects on the body.”

The USCIS granted him the NIW petition approval after thorough consideration. We are glad that our team’s efforts and our client’s cooperation are well acknowledged. We would like to congratulate him on achieving this milestone and permitting our law firm to be a part of this wonderful journey. We wish him all the luck in his future endeavors.
