Case Summary:

When USCIS issued a Request for Evidence (RFE), the question was narrowly focused. USCIS had already accepted that the client’s proposed endeavor possessed substantial merit and national importance, but it questioned whether the client was well positioned to advance the endeavor. The endeavor centered on advancing complex genetic and cellular research through advanced biochemical and computational methodologies, offering direct applications for agricultural biotechnology and biomedical innovation. To satisfy the outstanding NIW criteria, the RFE response strategically concentrated on detailing the client’s past technical accomplishments, sustained influence on independent researchers, and concrete future plans to demonstrate the client was exceptionally well positioned to advance this critical work.

An important part of the response was placing the client’s research record in the proper context. The client holds a Ph.D. and had developed expertise involving plant signaling, protein interactions, biochemical assays, proteomics, and related approaches. The record included 6 peer-reviewed journal articles and 1 preprint. By the RFE response, the client’s citation count had increased from 49 to 109.

North America Immigration Law Group (Chen Immigration Law Associates) used the RFE response to show what other scientists had actually done with the client’s findings. Independent researchers had actively applied the client’s advanced analytical methodologies to investigate complex mechanisms of disease resistance and defense in agricultural crops. Furthermore, outside scientists directly adopted the client’s foundational discoveries to interpret broader studies on environmental stress adaptation, including drought tolerance and overall plant resilience. Supporting letters submitted with the RFE response further addressed the client’s research capabilities and readiness to continue advancing the proposed endeavor.

The petition was filed on June 5th, 2025, followed by a premium processing upgrade on April 3rd, 2026. After USCIS issued the RFE on May 28th, 2026, NAILG prepared a detailed response centered on the client’s well-positioned showing, including updated citation evidence, independent implementation of the research, comparative impact data, and concrete future research plans. The petition finally reached approval after 15 months and 7 days. NAILG is honored to have assisted the client through the RFE process and in securing this NIW approval, and we wish the client continued success in advancing research with potential benefits for both agricultural and biomedical science in the United States.
