A research fellow from China who worked in chemistry was our client in this case. His specialized research had focused on specific topics in inorganic chemistry, nanotechnology and nanomaterials, and biological chemistry, such as novel aspects of virus glycoproteins during devastating virus-host infections. His body of work comprised 8 peer-reviewed scientific articles and 9 conference publications from presentations at national and international conferences and symposiums; by the time we filed his case, his research had received no fewer than 169 citations from independent and leading researchers at prestigious institutions and organizations around the world, a strong indication of the major significance of his work. He had also performed peer-review service for 19 distinctive, internationally-circulated journals, reviewing at least 34 manuscripts. An independent recommender testified to the importance of our client’s work and the exceptional nature of his ability: “[Client] is revolutionizing the use of antibodies to probe the characteristics and structure of a protein known as BAX. BAX is a member of a family of proteins that regulates apoptosis in cells—cancer and normal alike. [Client] has succeeded in developing an array of antibodies that bind to BAX, and he has described their binding properties on a very detailed level. As he continues to use them to uncover more information about BAX, the world will be granted in-depth knowledge about an important regulator protein that plays a role in preventing the spread of cancer when it is working correctly.” It was our goal to prove that our client qualified for classification as an Alien of Extraordinary Ability given that he sought to remain in the United States to continue work in the area of chemistry, and that his continued research would substantially and prospectively benefit the United States.
