Case Summary:

North America Immigration Law Group has been working with clients from all over the world on their immigrant and nonimmigrant visas for several years now, during which time we have collected thousands of clients and over 32,000 successful cases. This has given us the necessary experience to deal with all kinds of clients from various walks of life. So when we got an Indian client who is a research assistant professor working in molecular biology, we had our jobs cut out for us. Having worked with similar clientele in the past, we knew the route we needed to take.

So, our team began with a quick survey of his academic and professional career and moved on to sign the attorney-client agreement with him. Soon after this, we had begun picking up details like his proposed endeavor, benefits for the U.S., publications, citations, funding history, letters of recommendation, and so on. These factors were woven into his petition to give it the solid ground needed to prove the significance of his work for the U.S.

Some of these decisive factors were:

  • We said that he is one of the few leading DNA damage and repair experts in molecular biology, and he has achieved a consistent and notable record of success and influence in these areas of study.
  • We showed that his work has had major positive ramifications for numerous researchers who have been informed and guided by his myriad contributions to the field of molecular biology.
  • We also said that he has spent years investigating issues related to identifying unknown functions of repair proteins and discovering new proteins involved in mutagenesis and cancer and is regarded as an authority in the field. The field has recognized his authority by inviting him to review and evaluate the work of his peers no fewer than 22 times.
  • We added that his work has resulted in 15 peer-reviewed scientific articles and 1 book chapter. And these publications have been cited 185 times by researchers in at least 20 countries according to Google Scholar, thereby demonstrating that these publications are widely recognized and relied upon in the field of molecular biology.
  • Furthermore, we said that his study has been supported by funding from the National Science Foundation, the National Institutes of Health, and the Department of Energy.
  • Additionally, we asked him to produce at least 4 letters of reference (3 independent and 1 dependent) for his work from other experts who understood the significance of his work in the field. Two of them wrote the following in their recommendations:

“[The client] has devoted his career to the study of DNA repair pathways, which provides insight into the pathogenesis of cancer. According to the World Health Organization, cancer caused the deaths of about 10 million people across the globe in 2020 alone. In addition to negatively impacting human health and well-being, cancer represents a significant economic burden globally. As evidence of this, the cost of cancer in 2008 exceeded $890 billion. It is of great importance that we improve cancer treatment. In this regard, [the client’s] research is a boon.”

“[The client] gained insight into the mechanisms of cancer resistance to cisplatin, a widely used chemotherapy drug due to Set2 protein. In this way, he has made great strides in facilitating the improvement of treatment for cancer. Cancer is also a major outlay of economic resources, considering that cancer care cost the nation over $21 billion in 2019, and approximately $8.1 billion are spent on skin cancer treatment every year. [The client] seeks to reduce the burden of cancer, with a particular focus on skin cancer, in the United States, and his research is, therefore, an asset to the nation.”

Based on these factors, our team was able to prepare a solid petition for him winning him the National Interest Waiver(NIW) in less than 5 months. Even before the NIW approval had come through, he had decided to retain our services for his Alien of Extraordinary Ability (EB1-A) petition which we won for him in just 1 month. This was in part due to our excellent case preparation, our client’s credentials, and the premium processing upgrade.

We are glad to have worked with him on both of these cases and we wish him the best of luck in his future endeavors.
