Client’s Testimonial:

“I just received the approval of both my Eb1A and Eb2/NIW petitions. Working with the North America Immigration Law group had been a great experience for me.  I was very impressed with their effectiveness in all the communications and professionalism in preparing the recommendation letters and petition letters. It was very helpful that they were always prompt in answering my questions throughout the process which made me always feel that my petitions were in good hands. Overall, I’m very pleased with their service.  I would strongly recommend Chen immigration law group to anyone who are filing their Eb1a and Eb2/NIW I140 petitions.”

On March 15th and 21st, 2018, we received another EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability) approval for a Senior Scientist in the Field of Nutritional Biology (Approval Notice).

General Field: Nutritional Biology

Position at the Time of Case Filing: Senior Scientist

Country of Origin: China

State of Residence at the Time of Filing: Missouri

Approval Notice Date: March 15th, 2018 (NIW) and March 21st, 2018 (EB1A)

Processing Time: 7 months, 26 days (NIW) and 6 days (EB1A, Premium Processing Requested)

Case Summary:

A senior scientist from China approached North America Immigration Law Group (NAILG) to help her accomplish her dream of becoming an American permanent resident. After carefully reviewing her credentials and asking her questions related to her work, we determined that the best course of action would be for her to file two I-140 petitions: one under EB-2 NIW (National Interest Waiver) and another under EB-1A (Alien of Extraordinary Ability). The reason for this is because we wanted to increase our client’s chances of locking down an I-140 approval.

Building personalized petitions based on our client’s credentials:

We tackled the preparation of both our client’s EB1A and NIW petitions head-on and included an array of information pertaining to her work on mitochondrial diseases. We made sure to build both cases in such a way that our client’s skills and attributes took center stage. Our goal was to prove to the USCIS that our client is one of only a small handful of researchers who can achieve such impactful research results in the field of nutritional biology.

We also had to persuade the USCIS that our client’s work is beneficial to the United States, and we accomplished this by highlighting the shared patent in her name, her citation record, publication count, and peer review experience. When we filed our client’s NIW petition, these numbers stood at 121 citations, 7 publications, and 20 peer reviews respectively. However, when we filed her EB1A petition roughly 8 months later, these numbers had significantly increased to 140 citations, 8 publications and 40 peer reviews.

According to a well-known professor who contributed a recommendation letter to support both our client’s petitions, she is “One of the most influential researchers working today in nutritional biology…” This professor was not alone in his show of support for our client and was joined by several of his peers, all of whom also contributed recommendation letters of their own.

Obtaining two petition approvals:

To our client’s delight, both her NIW and EB1A petitions were approved without the issuance of a Request for Evidence (RFE).  These approvals are an encouraging sign of the effectiveness of our firm as well as our dedication to helping our clients craft petitions that emphasize their expertise in their respective fields. With a success rate of over 10,000 cases, there is no doubt that our firm has unprecedented insight into how the USCIS adjudicates cases. We congratulate our client and wish her all the best as she continues to advance the field of nutritional biology.
