Case Summary:

North America Immigration Law Group (NAILG) is pleased to have helped a gifted resident physician from China obtain two I-140 petition approvals—EB-2 NIW (National Interest Waiver) and EB-1A (Alien of Extraordinary Ability). Our client opted to file two petitions to increase the likelihood of securing an approval and he was fortunate enough to receive both approval notices just 13 days apart. With an M.D. and Ph.D. in Chemistry in the bag, our client is academically qualified to carry out impactful research in the field of oncology, which made him a suitable candidate for both visa categories.

Although EB-1A and NIW are upheld by different requirements, a significant amount of information included in our client’s two petition packets overlapped. Amongst other things, here are some of the key points that were used to strengthen both petitions:

  • We listed our client’s professional accomplishments such as the 120 citations gathered from his work, the 23 publications to his name, and the 54 times he conducted peer reviews for scientific journals.
  • In order to prove to the USCIS that our client deserved to have both his petitions approved, we had to account for his research in the field of oncology. After careful review, we determined that our client’s specialized research is focused on establishing prognostic models and biomarkers for various cancers, including glioma, lymphoma, and pancreatic cancer. We convinced the USCIS that our client’s findings contribute to medical research and the healthcare sector. Specifically, his biomarker research efforts are contributing to the United States’ approach to the treatment of cancer.
  • Both petition packets contained the same set of six recommendation letters contributed by our client’s peers. Not only did these letter briefly discuss our client’s research, they also verified just how important his work is to the country.
