On November 9^th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Senior Engineer/Postdoctoral Fellow in the Field of Chemical Engineering (Approval Notice).

Case Summary:

A senior engineer/postdoctoral fellow from China hired North America Immigration Law Group (WeGreened.com) when he decided that he wanted to become an American permanent resident. We filed two I-140 petitions for him: one under EB-2 NIW (National Interest Waiver) and the other under EB-1A (Alien of Extraordinary Ability). Our client was fortunate enough to have both his petitions approved, and this propelled him one big step closer towards his green card. We are especially glad that his EB-1A petition was approved as it allows him to file an I-485 application without waiting several years for his priority date to become current.

Building a strong EB-1A case:

In order to get our client’s EB-1A petition approved, we had to prove that he met at least three out of the 10 criteria put forth by the USCIS. After evaluating his credentials, we determined that he fulfilled the following criteria:

1. Notable citation count: We used Google Scholar to determine our client’s citation count. At the time of filing, this figure stood at 113 citations.
2. Impressive peer review record: When we filed his case, our client had already conducted 50 peer reviews for various high-impact scientific periodicals.
3. High publication count: Our client’s tireless work in the field of chemical engineering had led to the publication of 10 well-received scientific articles when we filed his case.

Besides the data mentioned above, our client’s EB-1A petition dossier contained information on his Ph.D. in Chemical and Biomolecular Engineering, evidence regarding his current employment, and six recommendation letters. These letters were gathered from other influential members of the field, one of whom stated that: “A perspective such as [Client’s] is not easily found in chemical engineering. He has a rare set of skills and a unique research outlook, which has propelled him to the front of the field…With his dual academic and industrial experience, [Client] has a rare research perspective that emphasizes industrial production and general usability. For this reason, [Client’s] research is necessary for the United States’ further development of renewable energy.”

Despite our best efforts, the USCIS issued a Request for Evidence (RFE), which we responded to promptly and effectively. As we were able to prove that our client’s work addresses some of the United States’ most pressing issues in understanding the significant advantages offered by biofuel and alternative energy technologies, the USCIS was persuaded to approve his EB-1A petition. We join our client as he celebrates this joyous occasion and we wish him the best as he continues to develop catalytic processes for sustainable and environmentally friendly energy production.
