Success Story: Despite Receiving an RFE, A Biomedical Engineering Researcher Achieved EB-1A Approval With Our Assistance

Case Summary:
Our firm is pleased to announce the successful approval of an EB-1A (Alien of Extraordinary Ability) petition for the client, an accomplished researcher in biomedical engineering. Although the case received a Request for Evidence, the petition was ultimately approved after we presented a clear record of sustained influence and field-wide trust in the client’s work across surface modification, biosensors, drug delivery, and polymer materials.
With a Ph.D. in biomedical engineering, the client has built a specialized research profile that bridges high-impact materials innovation and real-world applications. The petition highlighted the client’s well-known work developing eco-friendly agricultural superabsorbent polymers that incorporate modified starch and sugarcane bagasse with controlled-release fertilizers to support crop growth and quality in drought-prone settings, while improving nutrient management and water-use efficiency. We positioned this contribution as a strong example of original work with practical value, showing how the same materials expertise also supports broader advances in functional surfaces, biosensing platforms, and controlled-release delivery systems.
We strategically emphasized objective indicators of recognition and independent reliance, including:

We did not present these metrics as automatically sufficient. Instead, we explained how an adjudicator could reasonably interpret them as evidence of extraordinary ability in the aggregate. The citation record was framed as proof of independent reliance, meaning other researchers repeatedly used the client’s findings to inform and validate their own work. We also highlighted that multiple publications achieved top-tier citation performance relative to field norms, reinforcing that the influence was not isolated. Separately, the unusually extensive peer-review history was presented as a strong trust signal, since reputable journals typically invite reviewers who are recognized as credible authorities capable of assessing originality and technical rigor.
To further strengthen the case, we included 4 letters of recommendation from experts familiar with the client’s work, including independent perspectives. These letters corroborated the objective record and translated specialized technical contributions into clear significance for a non-specialist adjudicator.
