Case Summary:

The average processing time for I-140 cases is 4-6 months. But on many occasions, we have cases approved far faster than the average processing time. In this instance, the case was approved in only 26 days.

Another exceptional client that we had the pleasure of working with was an Assistant Research Scientist from India working in the field of Agricultural Science. The client came to us after his EB-1A case prepared by another firm had been denied.  The client’s work focused on studying the effect of global climate change on agricultural crops and his work had resulted in at least 16 peer-reviewed scientific articles.  Despite the fact that his case had previously been denied, we felt that the client had strong credentials and that we would have success filing a new case under EB-1A (Alien of Extraordinary Ability). At the time that his case was filed, his publications had accumulated at least 328 citations, clearly demonstrating that he had influenced the Agricultural Science field and garnered international acclaim. In addition, various experts and editors had requested his professional service as a reviewer of manuscripts for publication for 23 top-tier field journals and he had reviewed 27 papers at the time of filing. We also claimed a fourth criterion “Evidence of material published about the petitioner in professional or major trade publications or other major media”, and submitted evidence of 3 media reports about his work in major professional trade publications and media. Of his accomplishments, one of the independent recommenders remarked: “I affirm the significant impact of [his] studies on the field of environmental and plant biology.  As an agricultural researcher myself, I am able to firmly state that [he] has a gift for analysis of agricultural systems and a staunch record of contribution to the science of plant physiology.”  It was our goal to prove that our client qualified for classification as an Alien of Extraordinary Ability  given that he sought to remain in the United States to continue work in the area of Agricultural Science, and that his continued research would substantially and prospectively benefit the United States. Through extensive documentation, we successfully argued that our client met the requirements for EB-1A (Alien of Extraordinary Ability), and his I-140 petition was approved in just 26 days.
