Case Summary:

A graduate researcher from Iran approached North America Immigration Law Group (WeGreened.com) for help with his I-140 petition. We helped him put together a strong petition packet and filed it under the EB-2 NIW (National Interest Waiver) visa category. Nebraska Service Center spent a little over eight months adjudicating our client’s petition before granting their approval.

Our well-thought-out EB-2 NIW petition packet contained a myriad of information linked to our core argument: our client is an asset to the United States and that only a handful of other similarly qualified researchers can mirror his success. We documented everything from our client’s Ph.D. in Electrical Engineering to his development of advanced mathematical techniques for solving optimization problems related to wireless networks and multimedia communications. We also listed the 16 peer reviews that he carried out for a handful of high impact scientific journals and the 8 publications to his name. Furthermore, we noted the 155 citations collected from his many years of research in the field of wireless communication.

To bolster our EB-2 NIW petition, we urged our client to touch base with other specialists in his field. We needed him to obtain recommendation letters from them to incorporate into our petition packet. Our client managed to persuade four prominent experts to lend their support, all of whom volunteered letters that verified the significance of his contributions to the United States. According to one of them, our client’s work contributes “…to the security and well-being of the people of the United States.” Another expert stated that “Clearly [Client’s] unrivaled combination of experience, education, and skills make him ideally suited to continue changing the course of wireless communications…”

Immigrant Visa Processing:

Seeing that our client is not residing in the United States, he cannot file an I-485 application. Instead, he is now eligible for Immigrant Visa Processing, and must get it done at either an American consulate or embassy. Once approved, our client and his dependents may enter the United States as permanent residents. We wish him well with this step and look forward to receiving an update from him once he accomplishes his goal of getting a green card.
