Case Summary:

Exactly 8.5 months after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) petition on behalf of a research fellow from Iran, he received notification of case approval. It would have been far quicker had the USCIS not issued a Request for Evidence (RFE). However, as we efficiently and promptly responded to the RFE, the USCIS was persuaded to approve our client’s petition, propelling him significantly closer to a green card.

In preparing our client’s EB-2 NIW petition, we were sure to focus on various aspects of his career in the field of molecular biology. For instance, we documented his M.Sc. degree and his 8 published peer-reviewed journal articles, 16 abstracts, and numerous conference presentations and workshops. We also convinced our client to obtain recommendation letters from a handful of experts working in the field. We needed these letters to support our argument that our client is an asset not just to the field, but to the United States as a whole. To our delight, our client returned with six strong letters, one of which contained this statement: “Considering the country's need for improved cardiovascular health therapies, it would be unwise to prevent continuation of his work in the United States. His accomplishments and contributions indicate that he is among the strongest researchers in the field, and assure his work will continue to provide excellent improvements to coronary bypass surgery.”

Alongside these recommendation letters were details related to our client’s research projects on the molecular mechanisms of cancer cell proliferation as well as the biochemical and molecular biology approaches to prognostic and diagnostic markers in cancer and other diseases. We successfully demonstrated that our client’s research results have directly contributed to the country’s expertise in cancer research and to the development of more effective clinical care and prevention strategies for other diseases as well. Furthermore, his research efforts spanning the subjects of diabetes mellitus, multiple sclerosis, and cardiac surgery are reinforcing the strength and worldwide leadership role held by the United States’ healthcare system. We also noted the 32 times his findings were cited by various researchers around the world, proving that his work is essential to the overall advancement of the field.
