Success Stories: Our Firm Helped a Chinese Post-doctoral Researcher in the Field of Microbiology Secure NIW Approval in Less than 10 Months, Despite RFE

Client’s Testimonial:

“Thank you for your great efforts.”

On December 20th, 2019, we received another NIW (National Interest Waiver) approval for a Post-doctoral Researcher in the Field of Microbiology (Approval Notice).

General Field: Microbiology

Position at the Time of Case Filing: Post-doctoral Researcher

Country of Origin: China

State of Residence at the Time of Filing: Wisconsin

Approval Notice Date: December 20th, 2019

Processing Time: 9 months, 14 days

Case Summary:

As an expert in the field of microbiology, our client’s research focuses on plant pathology and agricultural sciences by developing new methods for treating diseases in plants and agricultural crops through fieldwork and experimentation. His research in this area is of great importance due to the global endeavor to reduce antibiotic and antimicrobial resistance. We worked with our client carefully and presented his various achievements to the USCIS in a clear and concise manner.

Apart from completing successful research in the field, our client has also published 12 peer-reviewed journal articles (2 of them first-authored) that collected 88 citations by the time when we were ready to file his case. He has also conducted 11 reviews for distinguished journals and conferences. The fact that his papers being published in the top journals and that his peers leveraged his research demonstrated that our client’s work is widely recognized and relied upon in his field. We incorporated the related material into his petition letter, and provided in-depth analysis to show the merit of our client’s endeavor.

Alongside the aforementioned information, we included 6 letters of recommendation signed by other influential researchers. These letters fully corroborate the independent and objective evidence that demonstrate our client’s original contributions. According to one of these recommenders: “[Our client] has uncovered new methods for treatment and suppression of fire blight that do not require the use of antibiotics. His compounds attack the disease at the molecular level, exploiting genes and molecular mechanisms to halt the growth of the bacteria responsible. [Client] has worked towards the goal of eradicating fire blight. He has found new means of protection for a major crop industry in the United States, ensuring the financial security for both growers and the industry on the whole.”

Although we presented a strong case to the USCIS, our client’s petition was issued a Request For Evidence (RFE). With our experience of securing over 16,000 I-140 approvals, we put together a solid response which eventually led to the case approval after 9 months and 14 days. We are glad that our hard work paid off and, we thank our client for choosing us to be a part of his success.
