Approval Notice Date: August 17th, 2022 (EB-1A) and September 21st, 2022 (NIW)

Case Summary:

Our client is one of the few leading images processing and data analytics experts in medical imaging, and she has achieved a consistent and notable record of success and influence in this area of study. When she hired us to help her in assembling an EB-2 NIW (National Interest Waiver) petition, we began to discern her documents and analyzed her research on managing metabolic bone diseases research imaging through designing image acquisition protocols, image and data analysis algorithms and publications. Therefore, we deduced that her research addresses some of our nation’s most pressing issues, including addressing the need for effective screening techniques for evaluating bone health.

Our objective was to convince USCIS that our client’s research is relevant to screening for bone fractures and standardizing and harmonizing data across scanner generations. When we presented her NIW case to the USCIS, after some time she also decided to retain us to help her in filing another petition under the EB-1A (Alien of Extraordinary Ability) visa category to extend her prospects to achieve green card success without any further hindrances. As several petitioners file more than one petition to get a major step closer to receiving their green cards.

In comparison, both the NIW and EB1A petitions are unique but they do have a few similarities while filing for their petitions. Here we listed a few of her achievements from her M.S. degree in biomedical engineering to highlighting her extraordinary record of 17 peer-reviewed journal articles (4 of them first-authored), 1 conference paper, 30 conference poster abstracts (9 of them first-authored), and 1 first-authored book chapter she published in international journals, amassing 320 citations from at least 31 countries. A number of her publications have also been cited at a much higher rate than those of other researchers in the field. Also, she has conducted 18 peer reviews, displaying her impressive accomplishments in her record of peer review, which is an essential part of the publication process and serves to maintain the standard of excellence of scientific journals, so her service as a peer reviewer is testament to her important role in her field and in the greater scientific community.

Moreover, we detailed that her work has also been granted financial support from the Endocrine Fellows Foundation, and the National Institute of Diabetes and Digestive and Kidney Diseases under the National Institutes of Health. Henceforth, this funding activity confirms the practical national importance of her research here in the United States.

The preexisting, independent, and objective evidence that her original contributions are of major significance is supported by contextual statements from four other experts in her field. The objective evidence submitted, which includes evidence of her notable national funding, her publication, and citation record, and her overall record of success and significant influence in the field, demonstrates that her findings are indeed original and represent unique and substantive contributions to the academic field of research. The below-mentioned recommendation excerpt has been plucked from one of the four submitted recommendation letters:

“With her unique skillset and the high caliber of her research contributions, [client] is an invaluable asset to the United States and its fight against this debilitating disease. It is therefore vital that she is provided with every resource necessary to continue her research in the United States without interruption.”

Despite waiting for months, our client successfully achieved both the NIW and EB1A petition approvals 1 month apart. We truly thank our client for choosing North America Immigration Law Group to represent her I-140 applications and wish her the best of luck in all her future endeavors.
