Case Summary:

With a Ph.D. in Biomedical Engineering obtained from a top university in her birth country of China, our client (a postdoctoral fellow), has the theoretical and practical knowledge to conduct outstanding research in the same field. Her work has led to numerous accomplishments such as 10 peer-reviewed scientific articles, 1 patent, and numerous presentations at national and international conferences. She hired North America Immigration Law Group (NAILG) to help her become an American permanent resident and as is apparent from the green card she recently attained, we did an excellent job.

Persuading the USCIS to grant our client a green card:

There are two steps in the green card process, namely the I-140 petition and the I-485 application. In this case, we filed our client’s I-140 under the EB-1A (Alien of Extraordinary Ability) visa category and as per our client’s request, I-485 applications for her and her daughter simultaneously. Less than a month after her EB-1A was approved, our client received news that the I-485 applications were also approved.

Selecting the right information to be included in the EB-1A petition packet:

Part of our services involved presenting a strong EB-1A case to the USCIS. We detailed our client’s citation count (88 citations at the time of filing) and her peer review record (30 reviews for several scientific journals). We also noted her research projects focused on improving the safety and efficacy of artificial cardiac valves, identifying markers for diagnosing coronary artery disease, and developing therapeutic agents for combating the effects of radiation exposure in human-like primate models. Furthermore, we incorporated recommendation letters that verified the importance of her investigations to public health and the American medical sector. Our client obtained these letters from six other influential members of the biomedical engineering research community, one of whom stated that: “The extraordinary achievements of [Client] demonstrate her innate ability to do exceptionally creative and superb scientific research and make her indispensable for progress in heart development and heart disease treatment. [Client] is without question one of the most important scientists in this field, and we must allow her to do research in our country. This is vital for our national interests.”
