Case Summary:

An Iranian research assistant immersed in the field of computer science engaged the expert services of North America Immigration Law Group (WeGreened.com) to help him overcome the first part of the two-step green card process: filing an I-140 petition. After carefully reviewing our client’s credentials, our evaluation team determined that he qualified for EB-2 NIW (National Interest Waiver) where he could self-petition and need not undergo the labor certification process.

With an M.Sc. in Electronics Engineering and comprehensive knowledge researching novel algorithms which offer improved defenses against several varieties of security breaches, our client was a suitable candidate for EB-2 NIW. We had to prove this fact to the USCIS and we did this by carefully reviewing his research projects and their benefits to the United States. Based on the wealth of information we gathered, we established that our client’s findings contribute to enhanced security measures for the protection of any information transmitted over wireless networks. Additionally, as he has developed security measures for wireless networks commonly used in government and military contexts, his specific research efforts are contributing to the United States’ national security.

The significance of our client’s research was highlighted by a well-known professor at a top American university. He stated that “The discontinuation of [Client’s] useful and implementable research would permanently affect the advancements made in the computer science field, and it would also hinder the drive for improved network architectures and improved network security.” This statement was taken from the recommendation letter he contributed in support of our client’s EB-2 NIW petition. Five other experts volunteered their support, and their letters played an important role in case approval. Besides these letter, we also included numerical data that documented the impact of our client’s work. For instance, we listed the 7 published articles to his name that had gathered 41 citations at the time of filing. These figures proved that dozens of other researchers around the world are using our client’s research results to build upon their own work and thus, progressing the field as a whole.

Overall, Texas Service Center (TSC) only spent 39 days processing our client’s petition before approving it—usually it takes them between 4-9 months. We would like to congratulate him for obtaining the national interest waiver and for getting one step closer towards his end goal of becoming an American permanent resident.
