Case Summary:

A little less than eight months after we filed an EB-2 NIW (National Interest Waiver) petition on our client’s behalf, Nebraska Service Center informed us that they had approved the case. Our client, a postdoctoral scientist from China, is working in the field of pharmacognosy. His studies focus on infectious disease treatment development and early diagnosis. We established that not only does our client’s work impact American pharmaceutical and biotechnology industries, it also contributes to the nation’s wellbeing and overall health.

Part of our effective legal strategy involved helping our client put together a detailed EB-2 NIW petition dossier that highlighted his many professional accomplishments. Here are some of the things that we incorporated:

  • Notable Citation and Publication Record

When we filed his EB-2 NIW petition, our client’s work had obtained over 40 citations and he had published almost a dozen journal articles and various conference presentations.

  • Strong Recommendation Letters

Recommendation letters make up a very important part of our legal strategy as they highlight the significance of our client’s work to others in the field. In this case, we included six letters in our petition packet. One of these letters stated that “The above outlined achievements have impressed upon me that [Client] is a remarkable scientist and researcher who is capable of addressing issues in pharmacognosy to a considerably greater degree than his peers. Few scientists possess the rare combination of skills needed to invent revolutionary new methods and to design and conduct the experimental studies required to mature these new technologies to the level of readiness required for a human diagnostic product.” Another recommender wrote, “Indeed, I would place [Client] in the upper 5% of postdoctoral researchers I have worked with over the past twenty years.”

  • Significant Research Efforts

In order to build an airtight case, our legal team had to carefully understand and detail our client’s research ventures. The information we obtained led us to conclude that not many other researchers in the field of pharmacognosy possess the skills and knowledge needed to carry out research of such high caliber the way our client has.

The approval of this NIW case is another example of North America Immigration Law Group’s dedication to helping all our clients get one step closer to their green card. Our client is now waiting for his priority date to become current before filing his I-485, the final step in green card proceedings. We look forward to helping him with his application when the time comes.
