Case Summary:

Our North America Immigration Law Group represented a foreign national from Iraq, who self-filed an EB-2 National Interest Waiver (NIW) Petition. Our client, a postdoctoral research scholar, researching to continue his development of fluorescent-tag transposon mutagenesis sequencing for identifying and assessing new regulators of type-3 secretion systems in bacteria, to enable new treatments for bacterial infections.

Our goal was to demonstrate that our client’s achievements; Ph.D. in cell and molecular biology, is a member of the professions holding an advanced degree. Also, his research is an endeavor with substantial merit and national importance, qualifying for a national interest waiver under the analytical framework set forth in the Matter of DHANASAR.

Firstly, we showed that our client’s intended research work is of great importance because it addresses healthcare-associated infections (HAIs), which affect hundreds of millions of people around the world each year and cause significant deaths and economic losses for healthcare systems, according to the World Health Organization.

To corroborate further, we emphasized a track record of his success with a degree of influence on the field as a whole. Here we are listing a few:

  • His research has been published in some of the top publication venues in his field, resulting in six peer-reviewed journal articles (five of them first-authored) and one first-authored book chapter.
  • He has published papers in no fewer than two highly ranked peer-reviewed journals, altogether accumulating 67 citations from many other experts, proving that he has had a major influence on other scholars’ understanding of topics in the field of microbiology.
  • In addition, his study has received funding from the U.S. Department of Agriculture’s National Institute of Food and Agriculture, and the National Institutes of Health. Therefore, his research undoubtedly is contributing to scientific advances that reduce and treat viral and bacterial infections, including those stemming from animals.
  • We also found two supporting letters of support from his fellow experts in the field, affirming that his research would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.

The evidence submitted is enclosed with reference letters from unbiased, independent experts which our attorneys helped draft along with proof of our client’s publications, memberships in organizations that require achievement as judged by recognized national or international experts, and discussion of his work by others.
